Notice of Privacy Practices

This Notice of Privacy Practices describes how medical information about you may be used and disclosed, and how you can access this information. Please review it carefully.

Your Rights

You have the right to:

  • Get an electronic or paper copy of your medical record
  • Ask us to correct your medical record
  • Request confidential communications
  • Ask us to limit the information we share
  • Get a list of those with whom we’ve shared your information
  • Get a copy of this privacy notice
  • Choose someone to act for you
  • File a complaint if you believe your privacy rights have been violated

Our Uses and Disclosures

We typically use or share your health information in the following ways:

  • Treatment: To provide, coordinate, or manage your healthcare
  • Payment: To bill and receive payment for services provided
  • Healthcare Operations: To run our practice, improve care, and contact you when necessary

Other Uses and Disclosures

We may also share your information as permitted or required by law for purposes such as public health reporting, research that meets federal privacy protections, health oversight activities, law enforcement or legal proceedings, and other legally required purposes.

We will never sell your information or use it for marketing purposes without your written authorization.

Our Responsibilities

We are required by law to:

  • Maintain the privacy and security of your protected health information (PHI)
  • Notify you promptly if a breach occurs that may have compromised the privacy or security of your information
  • Follow the duties and privacy practices described in this notice
  • Provide you with a copy of this notice

We will not use or share your information other than as described here unless you authorize us in writing or unless required or permitted by law.

Health Information Exchange Participation

BrightMed Clinic participates in the Kansas Health Information Network (KHIN), a secure electronic health information exchange (HIE). KHIN allows authorized healthcare providers and organizations involved in your care to securely access and share your health information to support treatment, payment, and healthcare operations.

Through KHIN, your health information may also be exchanged via national networks such as eHealth Exchange, Carequality, and the Trusted Exchange Framework and Common Agreement (TEFCA). This helps ensure continuity of care when you receive treatment from participating providers outside of BrightMed Clinic.

Your health information may be shared through KHIN for purposes permitted under HIPAA, including:

  • Treatment by current or future healthcare providers
  • Payment activities related to your care
  • Healthcare operations such as quality improvement and care coordination
  • Public health reporting and disease surveillance
  • Research that meets federal privacy standards

De-identified health information may be used for data analysis and population health purposes in accordance with HIPAA regulations.

You have the right to request restrictions on the sharing of your health information through KHIN. While we will honor such requests when required by law, certain disclosures may still be permitted or required.

Text Communication

BrightMed Clinic utilizes SMS/text messaging for brief, healthcare-related communications, including but not limited to appointment reminders, billing notices, and balance notifications. Standard message and data rates may apply.

You may opt out of receiving text messages at any time by notifying BrightMed Clinic staff or, when applicable, by replying STOP to a text message.

Ambient Artificial Intelligence Technology

Our clinicians (including physicians, nurse practitioners, and physician assistants) may use ambient artificial intelligence technology (sometimes referred to as “AI scribes”) to assist with clinical documentation. This technology is integrated into our electronic health record system and captures the clinical conversation for the purpose of generating a draft medical note.

The clinician reviews and edits the note to ensure accuracy and completeness before it becomes part of your medical record. Any conversation transcript or audio is used solely for clinical documentation and is deleted in accordance with the software vendor’s data retention policies.

You may request that this technology not be used during your visit by informing our staff or clinician. If you opt out, the clinician will document the visit manually.

Changes to This Notice

We reserve the right to change the terms of this Notice of Privacy Practices at any time. Any changes will apply to all protected health information we maintain. The updated notice will be available in our office and on our website.
